      <title>FELA Verdict in Colorado Upheld</title>
      <description>&lt;p&gt;In a &lt;a href="http://www.courts.state.co.us/coa/caseann/2006/2006q2/06-08-06.htm"&gt;FELA case&lt;/a&gt;,  the Colorado Court of Appeals on Thursday upheld a jury's decision to award a Union Pacific conductor, out of North Platte Nebraska, $6 million for injuries he suffered in a fall down the stairs of a locomotive.  The claimant suffered a traumatic brain injury as a result of the fall in August 1998.   A district court jury ruled that the Omaha, Neb.-based railroad was at fault under the Federal Employers Liability Act and that the railroad had destroyed locomotive inspection records that were likely favorable to plaintiff's case.  While it ruled in favor of the plaintiff in March on the railroad's appeal based on jury instructions, the Supreme Court sent the case back to the appeals court for work on other disputed issues.       <title>Pain and Its Causes</title>
      <description>&lt;p&gt;Thanks to my paraglegal, Christy Koch, for finding a &lt;a href="http://www.iasp-pain.org/PCUOpen.html"&gt;list of articles &lt;/a&gt; from the International Study of Pain.   The list of articles runs a gamet from pain in children, spinal pain, fibromyalgia pain, pain and depression, and on and on.       <title>Jury Service and Tort Reform</title>
      <description>&lt;p&gt;States are passing "Tort Reform" legislation that should make sense to everyone.  It is not about capping one group or another's liability or damages, but rather, it is about &lt;a href="http://www.law.com/jsp/nlj/PubArticleNLJ.jsp?id=1147424732337"&gt;fairness to jurors&lt;/a&gt;.  Jury service is a civil duty, but it can be very instrusive and a financial hardship on people.  My experience with jurors is that they take their job very seriously, but they are always put out by the imposition of jury service because of its inefficiencies and disruptions to their daily lives.
